1. Introduction
These Terms and Conditions (“Terms”) govern your use of the services provided by Web Sprout (Pty) Ltd (“Web Sprout”, “we”, “our”, or “us”), including the pagePod website builder, email hosting, and domain registration services (“the Services”). By using any of our Services, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years old to use our Services. By registering an account, you warrant that you have the legal capacity to enter into these Terms.
3. Service Description
- pagePod Website Builder: Lets you build, publish, and manage websites using our tools and infrastructure.
- Email Hosting: Provides custom email addresses and mailbox hosting linked to your domains.
- Domain Registration: Allows you to register, renew, or transfer domain names via our accredited registrar partners.
4. Account Registration & Security
- You must provide accurate, complete information during sign-up and keep your details up to date.
- You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized use of your account.
5. Acceptable Use
You agree to use our Services in compliance with our Acceptable Use Policy (“AUP”), which is incorporated by reference.
You must not use our Services for unlawful, harmful, or abusive purposes.
We may suspend or terminate your account for violations.
6. Customer Content
- You retain ownership of content you upload or create, but grant Web Sprout a license to store, back up, transmit, and display your content as needed to provide the Services.
- You are solely responsible for the legality, accuracy, and appropriateness of your content.
- We reserve the right to remove or disable access to content that violates these Terms or our AUP.
7. Domain Registration & Management
- Domain registration is subject to the rules of the respective registry and registrars. You are responsible for complying with those policies.
- We are not liable for domain registration failures, loss of domain names, or disputes unless caused by our gross negligence.
- Domain transfers may require your authorization and the provision of relevant codes (e.g., EPP).
- It is your responsibility to renew domains before their expiry.
8. Email Hosting
- You are responsible for managing your email accounts and settings.
- We do not guarantee delivery or receipt of any email. We are not liable for loss of email data unless due to our gross negligence.
- Use of email is subject to anti-spam laws and our AUP.
9. Payment, Fees, and Billing
- Service fees, billing cycles, and payment methods are specified on our website or in your order confirmation.
- Failure to pay may result in suspension or termination of your Services.
- Fees are subject to change. We will give reasonable notice of any changes.
10. Service Availability and Maintenance
- We aim to provide reliable, continuous service but do not guarantee 100% uptime.
- We may need to interrupt Services for maintenance or upgrades; we will try to give notice where possible.
11. Termination and Suspension
- You may terminate your account at any time via your account dashboard or by written notice to us.
- We may suspend or terminate your Services for breach of these Terms, non-payment, or legal requirements.
- Upon termination, we may delete your data from our systems.
12. Limitation of Liability
- To the fullest extent permitted by law, Web Sprout (Pty) Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or revenue.
- Our total liability for any claim is limited to the amount you have paid us for the affected Service in the past 12 months.
- Nothing in these Terms limits your rights under South African consumer law.
13. Indemnity
You agree to indemnify and hold harmless Web Sprout (Pty) Ltd and its staff from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.
14. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.
15. Changes to These Terms
We may amend these Terms from time to time. The latest version will always be posted on our website. Continued use of our Services means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of South Africa. Any disputes may be brought before a competent South African court.
